1. Acceptance of Terms

By creating an account or using SmartLearning ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. You must be at least 18 years old to create a parent account.

2. Description of Service

SmartLearning is an AI-powered adaptive learning platform for Grades 1-12 students, managed by parents. The Service provides personalized task generation, automated grading, mastery tracking, portfolio generation, and related educational tools. Content difficulty calibrates to standardized assessment levels (MAP, Lexile, Quantile).

3. Accounts & Billing

  • A parent account is required. Student accounts are created and managed by the parent.
  • Subscriptions are billed monthly via Stripe at the rate of the selected tier (Starter, Scholar, or Ivy).
  • Each plan includes a monthly credit allocation. Credits reset at the start of each billing cycle and do not roll over.
  • Portfolio Pro ($350) is a one-time purchase providing 30 days of unlimited admissions material generation. It requires an active subscription.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We offer a 30-day money-back guarantee for first-time subscribers.

4. Acceptable Use

You agree not to:

  • Share account credentials with unauthorized users.
  • Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use.
  • Use automated tools to interact with the Service (bots, scrapers).
  • Submit content that is offensive, harmful, or violates any law.
  • Resell or redistribute generated content for commercial purposes.

5. AI-Generated Content

SmartLearning uses AI models (including OpenAI) to generate educational content, grade submissions, and produce portfolio materials. While we employ a 3-layer anti-hallucination system (verified question banks, dual-AI verification, answer validation), AI-generated content may occasionally contain errors. The Service is a supplementary educational tool, not a replacement for professional instruction or standardized assessment.

6. Intellectual Property

  • Student-created content (essays, responses) remains the property of the student/parent.
  • AI-generated materials (grading feedback, portfolio narratives, executive summaries) are licensed to the subscribing family for personal and educational use.
  • The SmartLearning platform, design, and proprietary algorithms are owned by SmartLearning.
  • Open-source question bank content (GSM8K, Hendrycks MATH) is used under their respective MIT licenses.

7. Limitation of Liability

SmartLearning is provided "as is" without warranties of any kind. We are not liable for any damages arising from the use of the Service, including but not limited to academic outcomes, school application results, or decisions made based on AI-generated content. Our total liability shall not exceed the amount paid by you in the 12 months preceding any claim.

8. Termination

We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, access to the Service will cease immediately. You may request export of your data before account deletion.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to the address on your account. Continued use of the Service after changes constitutes acceptance of the updated Terms.
